PataFundi Terms and Conditions

1. Acceptance of Terms

Welcome to PataFundi ("Service," "Platform," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website, mobile applications, and services. By accessing or using the PataFundi platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Service Description

PataFundi provides an online platform that connects skilled artisans ("Artisans") in the building and construction industry with individuals or companies ("Employers") seeking their services for specific jobs or projects. PataFundi facilitates these connections but is not a direct employer of Artisans or a direct contractor for Employers beyond providing the platform services.

3. User Accounts and Responsibilities

3.1. Account Registration

To access certain features of the Platform, both Artisans and Employers must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2. Artisan Accounts

Artisans may be required to pay a one-time registration fee, as detailed during the sign-up process. Artisans are responsible for the accuracy of their profile information, including skills, experience, qualifications, and portfolio. PataFundi may offer verification services but does not guarantee the skills or quality of work of any Artisan.

3.3. Employer Accounts

Employers are responsible for accurately describing their job requirements and terms of engagement. Employers acknowledge that PataFundi is a platform provider and is not responsible for the performance or conduct of Artisans hired through the Platform.

3.4. Account Security

You are responsible for safeguarding your password and any other credentials used to access your account. You agree not to disclose your password to any third party. You must notify PataFundi immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Conduct

All users agree not to use the Platform for any unlawful purpose or in any way that interrupts, damages, or impairs the service. Users must not attempt to gain unauthorized access to the Platform or any networks, servers, or computer systems connected to the Platform.

5. Payments and Fees

PataFundi may charge fees for certain services, such as Artisan registration or premium features for Employers. All applicable fees will be clearly disclosed prior to any transaction. Payments made through the platform are subject to the terms of our payment processors.

6. Intellectual Property

The PataFundi Platform and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of PataFundi and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PataFundi.

7. Disclaimers and Limitation of Liability

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. PataFundi makes no warranties, expressed or implied, regarding the operation of the Platform or the information, content, materials, or products included on the Platform. To the full extent permissible by applicable law, PataFundi disclaims all warranties, expressed or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

PataFundi will not be liable for any damages of any kind arising from the use of this Platform, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

8. Termination of Service

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the PataFundi platform will be subject to the exclusive jurisdiction of the courts of Kenya.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
